Establishing Paternity in Florida
In Florida, there is only one circumstance where paternity is automatically assumed. If you and your spouse are married, any children born to you will be automatically considered your biological children, unless there is a dispute. However, if you are not married at the time of the birth, then paternity will need to be established.
You can do this in a variety of ways:
- Administrative order based on genetic tests
- Court order, which may or may not require genetic tests
Legitimation is the process of changing the child’s birth certificate to reflect paternity. This option is available if you and the other parent get married after the child is born. You must update the birth record and notify the Florida Office of Vital Statistics. No other father must be named on the original birth certificate.
Acknowledgement refers to a simple process of signing a legal document saying you are the child’s father. Even if you are not married, you and the other parent can sign a document establishing paternity. This document may be signed at the hospital at the time of birth, or at any point later on.
If paternity is in question, genetic testing may be used to prove who the biological father is. These tests are provided for free by the Florida Department of Revenue (DOR). If paternity is disputed by either party, a court order may also be used to legally establish paternity, even if genetic tests have not been conducted.
