Case Update- 14 Day Issue

As you know the Florida PIP Statute was changed to prohibit PIP benefits to people who didn’t receive treatment within 14 days after a motor vehicle accident. Simply put, this part of the law is stupid. Some people don’t experience pain right after the accident. Some people think the pain will go away so they don’t bother to treat within the 14 days.

There is a case on appeal right in Broward challenging the 14 day rule. Basically, the doctor treated a patient on day 15, billed PIP, was denied, and filed a PIP suit. The court dismissed the case because the patient didn’t treat within 14 days and the case was appealed.
